AN ORDINANCE ESTABLISHING A PROCEDURE BY WHICH CERTAIN
REAL PROPERTY OR LANDS OWNED BY THE TOWN OF JOHNSON,
WASHINGTON COUNTY, ARKANSAS MAY BE CONVEYED AFTER CITY WIDE
ELECTION, AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF JOHNSON, WASHINGTON
COUNTY, ARKANSAS:
WHEREAS, the Town Council of the Town of Johnson, Washington
County, Arkansa's, is presently the owner of certain tracts and
parcels of real property lying within and/or ·without the city limits
of the Town of Johnson; and
WHEREAS, the Town Council of the Town of Johnson, Washington
County, Arkansas, wishes to establish a procedure by which said
parcels or tracts of real property may be sold after having held
a city-wide election; and
WHEREAS, it has been deemed advisable to require that the
registered voters or electorate of the Town of Johnson, Washington
County, Arkansas, hold such elections prior to the city being
empowered or authorized to convey any tracts or parcels of
real estate owned presently or to be acquired in the future:
NOH, THEREFORE, BE IT ORDAINED BY THE TOHN COUNCIL OF THE
TOHN OF JOHNSON, HASHINGTON COUNTY, ARKANSAS:
SECTION l. SALE OF LANDS
If and in the event the Town Council of the Town of Johnson,
Washington County, Arkansas, desires ·to convey, sell, mortgage,
encumber, or otherwise di~pose of any ownership interest in any
tract or parcel of real estate or real property o'med by said
to,m, a majority of the. registered voters of the Tmm of Johnson,
Washington County, Arkansas, shall as a condition precedent
to said conveyance approve and ratify said conveyance by a
general city-wide election by simple majority vote of all registered
voters within the city limits of the Town of Johnson,
Hashing ton County, Arkansas. ·
SECTION 2. FULL DISCLOSURE

the question to be voted on shall set forth in general and ordinary
language all financial particulars of the purposed transaction
including, but not limited to: a legal and layman's description
of the property to be conveyed; the consideration given by the
town for such property; the complete identity of the'purchasers of
the property; a complete and accurate resitation of all considerations
and financing atrangemehts to be made and entered.into by
any purposed purchasers with the town; all special conditions, re-
·strictions, convenants or easements affected together with all
other material facts and matters as might exist and be pertinant
to the purposed transaction. Provided further that no sale or
transfer or conveyance of real parcels shall be effectuated by the
town unless said election is held and ratified by a majority of the
registered voters more than th:Lrty (30) days next before the actual
closing date of said purposed conveyance.
SECTION 3. CITY-HIDE GENERAL ELECTION
The election seeking ratification and approval of the registered
voters of the Town of Johnson, Washington County, Arkansas,
in which approval of said sale or conveyance is sought shall be by
existing ordinance establishing a method for calling special, general
or city-wide elections.
SECTION 4.
That all other ordinances or ammendments to ordinances in conflict
herein are expresslyrepealed.
SECTION 5.
That due to the cituation as it presently exists in the Town
of Johnson, Washington County, Arkansas, it is necessary for the
peace, health and safety and welfare of the citizens of the Town
of Johnson that this ordinance be encated and an emergency is hereby
declared to exist, and this ordiance shall take effect and be
in full force and effect from and after the day of its passage.
