AN ORDINANCE DEFINING  AND REGULATING INSTALLATION OF INDEPENDENT MOBILE HOMES:
ESTABLISHING MINIMUM STANDARDS GOVERNING THE UTILITIES AJID FACILITIES AND OTHER
PHYSICAL THINGS AND CONDITTION TO MADE A MOBILE HOME SAFE, SANITARY: FIXING THE
RESPONSIBILITiES OF THE OWNERS OF THE MOBILE HOME, AUTHORIZING THE INSPECTION
and FIXING PENALITIES FOR VIOLATIONS:

BE IT ORDAINED BY THE TOWN OF JOHNSON AS FOLLOWS:

 

PURPOSE :

THE PURPOSE OF THIS ORDINANCE IS TO DEFINE THE RULES REGULATING THE INSTALLATION
OF INDEPENDENT MOBILE HOMES WITHIN THE CITY LIMITS OF THE CITY OF JOHNSON IN THE COUNTY OF WASHINGTON IN ThE STATE OF ARKANSAS.

SECTION l DEFINITION:

AN INDEPENDENT MOBILE HOME IS A MOBILE HOME THAT HAS A FLUSH TOILET, AND BATH OR SHOWER, AND/OR SLEEPING QUARTERS.

SECTION 2 PERMITS
IT SHALL BE UNLAWFUL FOR ANY PERSON TO INSTALL AN INDEPENDENT MOBILE HOME WIITHIN THE CITY LIMITS OF THE CITY Of JOHNSON WITHOUT A VALID PERMIT ISSUED BYTHE TOWN CLERK FOLLOWING A CONFIRMATION HEARING BY THE JOHNSON PLANNING COMMISSION AND THE TOWN COUNCIL IN THE NAME OF SUCH PERSON FOR TilE SPECIFIC INDEPENDANT MOBILE HOME,
APPLICATION FOR SUCH A PERMIT MUST BE ACCOMPANIED BY A VALID DRAWING SHOWING TilE
EXACT LOCATION OF Tl!E MOBILE HOME, GIVING THE LOT SIZE, SIZE OF THE M0BILE HOME,
AND SIZE AND LOCATION OF THE DRIVEWAY. THE DRIVEWAY MUST BE SITUATED SO AS TO
GIVE THE PERSONS USING IT A CLEAR AND UNOBSTRUCTED VIEW OF THE STREET UPON WHICH
IT WILL ENTER.
SECTION 3 WATER SUPPLY:
AN ACCESSIBLE, ADEQUATE, SAFE AND POTABLE WATER SUPPLY SHALL BE PROVIDED, CAPABLE
OF FURNISHING A MINIMUM OF 150 GALLONS PER DAY. WHERE A PUBLIC SUPPLY OF WATER IS AVAILABLE, CONNECTION SHALL BE MADE THERETO AND IT'S SUPPLY SHALL BE USED  WATER SUPPLY CONNECTIONS SHALL BE SO CONSTRUCTED THAT THEY WILL NOT BE DAMAGED BY THE PARKING OF THE MOBILE HOME,
SECTION 4 SEWAGE DISPOSAL.
ALL PLUMBING SHALL COMPLY WITH STATE AND LOCAL PLUMBING LAWS AND REGULATIONS.
EACH MOBILE HOME SHALL llE PROVIDED WITH AT LEAST A 3 INCH SEWER CONNECTION. THE SEWER CONNECTION SHALL, BE PROVIDED YTITH SUITABLE FITTINGS, SO THAT WATER TIGHT
CONNECTIONS CAN BE MADE BETWEEN Tl!E MOBILE HOME DRAIN ANIJ THE SEWER COl'fNECTION.
SiJCH MOBILE HOME COUNECTIOHS SHALL BE SO COHSTHUGTED THAT THEY CAI'f BE CLOSED WHEN
NOT LIN.KED TO A MOBILE HOME AND CAPPED SO AS TO PREVENT ANY ESCAPE OF ODORS
SEWER LINES SHALL BE CONSTRUCTED IN ACGOHDANGE WITH PLANS APPROVED IN WRITING BY

THE SUPERINTENDENT OF THE SPRINGDALE WATER AND SEWER DEPARTMENT OR IT'S AUTHORIZED
AGENT. ALL SEWER LINES SHALL BE ADEQUALTELY VENTED AND SHALL BE LAID WITH SUFFICIENT
EARTH COVER TO PREVENY BREAKAGE FROM TRAFFIC.

SECTION 5 REFUSE DISPOSAL
THE STORAGE, COLLECTION AND DISPOSAL OF REFUSE AT A lf.OBILE HOME SHALL BE SO MANAGED
AS TO CREATE NO REALTH HAZARD, RODENT HARBORAGE, INSECT-BREEDING AREAS, ACCIDENTS,
FIRE HAZARD, OR AIR POLLUTION.
SECTION 6 ELECTRICITY
THE INSTALLATION OF ELECTRICITY TO A MOBII.E HOME SHALL COMPLY WITH ALL APPLICABLE
STA'fE AND LOCAL ELECTRICAL CODES AND ORDINANCES. NO MAIN POWER SUPPLY SHALL BE
PERMITTED TO LIE ON THE GROUND, OR BE SUSPENDED LESS THAN 18 FEET ABOVE THB GROUND.
ALL ELECTRICAL OUTLETS AND/OR CONNECTIONS SHALL BE GROUNDED AND WEATHERPROOFED.

SECTION 7 HEATING

HEATING SHALL BE BY NATURAL GAS INSTALLATION OF NATURAL GAS SHALL COMPLY WITH
ALL APPLICABLE STATE AND LOCAL CODES ELECTRIC HEAT WAY BE USED AS AN OPTION IF
SO DESIRED.

SECTION 8 ALTERATIONS AND ADDITIONS:

MOBILE HOMRS MUST BE COMPLETELY SKIRTED AND AREAS ENCLOSED BY SUCH SKIRTING SHALL
BE MAIN-TAINED SO AS NOT TO PROVIDE A HARBORAGE FOR RODENTS, OR CREATE A FIRE
HAZARD. WHEELS, AXLES, AND TONGDES SHALL BE REMOVED.

SECTION 9 INSPECTIONS:
ALL INSTALLATIONS OF MOBILE HOMES MUST BE INSPECTED BY THE JOHNSON CITY BUILDING
INSPECTOR BEFORE OCCUPANCY CAN BE ALL0WED.

SECTION 10 EMERGENCY
IT IS ASCERTAINED BY Tl!E CITY COUNCIL AND DECLARED THAT THE SAFETY AND HEALTH
OF THE CITIZENS OF THE TOWN OF JOHNSON ARE JEPARDIZED BY THE LACK OF AN ORDERLY
PROCEDURE FOR SETTING A MOBILE HOME WITHIN THE TOWN OF JOHNSON, ARKANSAS, IT
IS, THEREFORE, DECLARED THAT AN EMERGENCY EXISTS: THAT THIS ORDINANCE IS NECESSARY
FOR THE IMMEDIATE PRESERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY.
