AN ORDINANCE RELATIVE TO THE OFFICE OF CITY
ATTORNEY AND PROSECUTION OF VIOLATIONS OF
THE ARKANSAS HOT CHECK LAW.
WHEREAS, the Marshall's office for Johnson, Arkansas, has
previously processed complaints, affidavits for warrants, and information
concerning violations of the Arkansas Hot Check Law
(Arkansas Statutes Annotated §§67-729 - 67-724, as amended); and,
WHEREAS, the jurisdiction of the City Attorney and the
Marshall's office for the City of Johnson, Arkansas, is concurrent
with the jurisdiction of the Prosecuting Attorney for the State of
Arkansas, 4th Judicial District, and the Washington County Sheriff's
Office, with respect to the prosecution of violations of the Arkansas
Hot Check Law; and,
WHEREAS, it has come to the attention of this Council that
the demand upon the resources of the City of Johnson concerning the
resources of the City of Johnson concerning the prosecution of
violations of the Arkansas Hot Check Law are excessive in relation
to the benefits provided the citizens of this City; and
WHEREAS, the great bulk of complaints, warrants for arrest
and informations concerning violations of the Arkansas Hot Check
Law deal with offenses wherein the amounts are less than Twenty-
Five Dollars ($25.00);
Therefore, BE IT ORDAINED, by the City Council of the City
of Johnson, Arkansas, that in order to insure quality police protection
and law enforcement within the confines of this municipality
by the Marshall's Office of Johnson, Arkansas, that the City Attorney
and Office of the Marshall for the City of Johnson, Arkansas, be
directed to defer prosecution of violations of the Arkansas Hot
Check Law to the Prosecuting Attorney for the State of Arkansas,
4th Judicial District, wherein the amounts concerned are less than
Twenty-Five Dollars ($25.00).
That the City Council of the City of Johnson, Arkansas,
further determine that this ordinance is necessary to adequately
and properly protect the public peace, health, and safety of the
inhabitants of the said City, therefore, an emergency is hereby
declared to exist and this ordinance shall be in full force and
effect from and after its passage and publication.
