AN ORDINANCE RELATIVE''.TO COLLECTION OF ADDITIONAL COSTS
BY THE JOHNSON CITY COURT IN CASES OF CONVICTION OF
DRUNKENESS OR DRIVING WHILE UNDER THE INFLUENCE OF
INTOXICANTS
WHEREAS, 'Act 1951, No. 275, §1, §2, and §3 as an Amendment
to Arkansas Statutes 1947 Annotated §22-706.1 through 22-706.3
(1962 Repl.), provides for the taxation and collection of costs
upon each judgment of conviction for the charge of public drunkeness'in
the amount of $1.00 and .for the charge of driving'while
under the influence of intoxicants in the amount of $5.00 and
then provides for the administrative steps to be taken in effectuating
such law by the appropriate officials; and,
WHEREAS, the Johnson City Court'is subject to the provisions
of the aforementioned law and should therefore commence the collection,
accounting, and reporting of said costs;
THEREFORE, BE IT ORDAINED, By the City Council of the City
of Johnson, Arkansas, that in compliance with Arkansas Statutes
1947 Annotated §§22-706.1 through 22-706.3 (1962 Repl.), the
Johnson City Court shall, in addition to all other costs now or
hereafter provided by law, tax and collect from each Defendant
as costs upon each judgment of conviction the sum of $1.00 if
such conviction is for the charge of public drunkeness, and the
sum of $5.00 if the conviction is for the charge of driving
while under the influence of intoxicants; and the Court Clerk
is hereby directed and ordered to collect such costs herein
taxed and assessed in the same manner and at the same time as the
other costs in such cases. The Court Clerk is hereby directed
and ordered to keep such funds as collected in a separate account
and accounted for and paid over to the city treasurer at the
same time and in the same manner as other Court costs in the
first class of accounts,
BE IT FURTHER ORDAINED, By the City Council of-the City of
Johnson, Arkansas', that costs collected under this Ordinance shall
be paid into a fund to be used in the purchase, maintenance, and
operation of equipment designed to test the fact and degree of
intoxication of persons arrested on charges of public drunkeness,
or driving under the influence of intoxicants. The surplus, if
any, after accomplishment of the above purpose, may be used in
defraying any other legitimate administrative expense of the
Court.
IT IS FURTHER DETERMINED By the City Council of the City of
Johnson, Arkansas, that this Ordinance is necessary to adequately
and properly protect the public peace, health, and safety of the
inhabitants of the said City, therefore, an emergency is hereby
declared to exist and this Ordinance shall be in full force and
effect from and after its passage and publication.
