AN ORDINANCE LEVYING A FEE ON THE OWNERSHIP

AND/OR POSSESSION OF DOGS AND/OR CATS WITHIN

THE CITY OF JOHNSON, ARKANSAS

WHEREAS, the City Council of Johnson. Arkansas

determined that it is in the best interests of the citizens

and residents of the City of Johnson to regulate, in an orderly

manner, the keeping, owning, and/or possessing of dogs and/or
cats within the corporate limits of said City; and,
WHEREAS, there is an emergency situation concerning
stray and unclaimed dogs and/or cats within the corporate limits
of the City of Johnson; and,
WHEREAS, enforcement of local Ordinance No. 33 is
severely restricted due to the inability of enforcement personnel
to locate and identify the owner, keeper, and/or party
responsible for dogs and/or cats within the corporate limits
of the City of Johnson;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL,
CITY OF JOHNSON, ARKANSAS:
SECTION I: There is hereby levied and there shall be
collected an annual fee, in the amounts hereafter provided, on
each dog and/or cat owned or kept within the City of Johnson, >
Arkansas. Said fee shall be paid to the City Clerk (or collected
by a licensed veterinarian, practicing within the City, for the
City Clerk). It shall be the duty of any licensed veterinarian k
collecting a fee under the provisions of this section to remit b
said fee to the city controller by the 10th of the month next &
following-the month in which said fee is collected.
SECTION II: The tax levied hereby shall be as follows '
if paid prior to the 31st day of May each year: I;
a) for each male dog/cat (neutered) $2.00; ^
b) for each male dog/cat (unneutered) $2.00; ;.
c) for each female dog/cat (spayed) $2.00;
d) for each female dog/cat (unspayed) $2.00.
If the aforesaid fee is not paid prior to the 31st day of May,
an additional fee of $1.00 per month shall be added to those
amounts set forth above in each instance.
SECTION III; Should a dog and/or cat be brought into
the city, or obtain the age of five (5) months after the first
day of May, the person owning or keeping such dog and/or cat
shall have thirty (30) days in which to pay the fee levied
hereby. Any person failing to pay said fee within such period
shall be required to pay the applicable higher fee specified
above.
SECTION IV: The City Clerk or a licensed veterinarian
to whom the fee levied by Section I above is paid shall issue
a receipt therefor and shall issue to each person paying said
fee a metal tag indicating that said fee has been paid for the
current year; provided, a tag for any dog and/or .cat shall not
be issued unless a certificate is presented which indicates
that said dog and/or cat has been vaccinated for rabies and
distemper within sixty (60) days prior thereto,
SECTION V: It shall be the duty of the owner .or keeper
of every dog and/or cat within the City of Johnson to attach
the tag provided for in Section IV to a collar securely fixed
around the neck of said dog and/or cat.
SE CT TON_VI: Nothing in this section shall be construed
to apply to any dog and/or cat under the age of five (5) months
on the first day of May of the current year or to dogs and/or
cats brought into the city on a temporary basis for show or
exhibition.
SECTION VII: The animal control officer is authorized
to take into custody any dog and/or cat found running at large
within the corporate limits of the city in violation of the
terms and provisions of this article and to place the same in
the facility hereby designated as the City of Springdale Animal
shelter.

Whenever any animal in the animal shelter bears a City
of Johnson tag, it shall be the duty of the animal control
officer to notify the owner or the person to whom the tag was
issued, if such person or owner can be found, that the animal
has been taken up and placed in the animal shelter and will
be destroyed or released to a humane society within ten (10)
days unless the fee hereinafter prescribed is paid. If the
owner or person to whom the tag was issued cannot be found,
the animal control officer shall, by registered mail sent to
said person's last known address, notify said person that the
animal has been impounded at the animal shelter, and will be
destroyed or released to a humane society within ten (10) days
if the fee hereinafter prescribed is not paid. For the purpose
of this section, the first day of taking up shall be counted
as the first day of the impoundment period provided herein.
SECTION VIII: After the expiration of ten (10) days
impoundment in the case of a licensed animal, or the expiration
of five (5) days impoundment in the case of an unlicensed animal,
said animal shall become the property of the City of Johnson,
and the city shall be empowered to release said animal to a
humane society or to destroy and dispose of said animal. Ten
(10) days after any licensed animal has been impounded, as provided
for in Section VII above, the animal control officer is hereby
authorized to release said animal to a humane society or to
destroy such animal and dispose of the carcass. For the purpose
of this section, the day of taking up shall be counted as the
first day of the impoundment period herein provided.
SECTION IX: The owner of an impounded animal may, at
any time, before said animal is destroyed or released to a humane
society, claim said animal and have the same released to him
upon payment of the costs of impoundment. Said costs are hereby
ascertained to be $25.00 impoundment fee for the first pickup,
$50.00 for the second pickup of the same animal within a twelvemonth
period, and $75.00-$100.00 for each subsequent pickup of

the same animal within a twelve-month period, plus animal
shelter daily charge for each day such animal is impounded in
the animal shelter, together with the fee on such animal, if
the same has not been paid, plus the cost of having an unvaccinated
animal vaccinated for rabies and distemper. The initial
impoundment fee for unlicensed or unvaccinated dogs and/or
cats shall be as per animal shelter charges.
The impoundment costs specified above shall be paid to
the animal shelter control officer.
THIS ORDINANCE shall be in full force and effect from,
and after its passage, approval, publication and recording of
a certified copy thereof in the office of the Circuit Clerk and
Ex-Officio Recorder of Washington County, Arkansas.
