Ordiance #97

AN ORDINANCE REGULATING THE ERECTION,
CONSTRUCTION, REPAIR, ALTERATION LOCATION, OR
MAINTENANCE OF ADVERTISING STRUCTURES, SIGNS,
BILLBOARDS, OR OUTDOOR ADVERTISING STRUCTURES
WITHIN THE CITY OF JOHNSON, ARKANSAS;
PROVIDING PENALTIES FOR VIOLATION THEREOF; AND
FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL FOR THE
CITY OF JOHNSON, ARKANSAS.

 

CHAPTER 1
SECTION !_;_ The purpose of this code is to provide minimum
standards to safeguard life, health, property and the public
welfare by regulating and controlling the design, quality and
maintenance of all signs and sign structures not located within a
building.
SECTION 2: Authority: The Chief of Police -is hereby
authorized and directed to enforce all of the provisions of this
code.
Right of Entry: Upon proper presentation of credentials,
the Chief of Police or his duly authorized representatives, may
enter, at reasonable times, any building, structure, or premises
in the City to perform any duty imposed upon him by this
ordinance.
Violation and Penalties: It shall be unlawful for any
person, firm or corporation to erect, construct, enlarge, alter,
repair, move, improve, remove, convert, demolish, equip, use or
maintain any sign or sign structure in the City, or causa or
permit the same to be done, contrary to or in any violations of
the provisions of this Ordinance.
 Any person, firm, or corporal;!on violating any of the
provisions of this Code shall be guilty of a misdemeanor, and
each such person shall be deemed guilty of a separate offense for
each and every day, or portion thereof, during which any
violation of any of the provisions of this Code is committed,
continued, or permitted, and upon conviction of any such
violation, such person shall be punished by a fine of not less
than $5000, nor more than $15.00., per day for each day that the
offense continues.

CHAPTER 2
X No sign shall be hereafter erected, re-erected,
constructed , altered except as provided by this Code .
SECTION 2 : A sign is defined as any medium including it
structure and component parts , which is used or intended to be
used to attract attention to the subject matter for advertising
purposes other than paint on the surface of a building.
SECTION 3 ;_ Outdoor advertising structures will not be
permitted within the city limits of Johnson, Arkansas.
SECTION 4: No sign shall be permitted which may interfere
with, obstruct the view of, or be confused or conflict with any
authorized traffic sign , signal , or device , by location as to
interfere with, misle'ad or confuse traffic. No sign shall be
permitted which constitutes a nuisance or safety hazard because
of lighting, glare, focus or flashing of sign.
CHAPTER 3
VALIDITY AND SEVERABILITY OF ORDINANCE
If for any reason, if any one or more sections, sentences,
clauses or parts of this ordinanc.e are held to be
unconstitutional or otherwise invalid, such judgment or decision
shall not affect , impare or invalidate the remaining provis ions
of this ordinance, but shall be confined in its operation of
specific sections, sentences, clauses or parts of. this ordinance
held invalid and the validity of any section, sentence, clause or
any parts of this ordinance in any one or more instances shall
not affect the prejudice in any way the validity of this
ordinance and any other instance.
CHAPTER 4
All sections of ordinance Twenty-three, the Zoning.
ordinance, more specifically the section three dealing with signs
affixed to occupation building in residential zones is not
affected by this ordinance.
CHAPTER 5
It is ascertained by the City Council and declared that the
safety and health of the citizens of the city of Johnson are
jeopardized by the lack of an orderly procedure for construction
and maintenance of outdoor signs and advertising structure within
the City of Johnson, Arkansas.

IT IS THEREFORE, DECLARED THAT AH EMERGENCY EXISTS; that
this ordinance is necessary for the immediate preservation of
public peace, health -and safety. In that this ordinance shall
take effect and be in full force from and after its passage,
