AN ORDINANCE GRANTING AN EXCLUSIVE FRANCHISE TO
WATER COMMISSION, TO MAINTAIN AND OPERATE A
WATER DISTRIBUTION SYSTEM, WITHIN THAT AREA
OF THE CORPORATE LIMITS OF THE CITY OF  JOHNSON,
WASHINGTON COUNTY, ARKANSAS, LYING NORTH OF CLEAR CREEK

 

WHEREAS, the City of Springdale, acting through its water
commission, currently operates and maintains a public water
QQ distribution system north of Clear Creek in the City of Johnson,
Arkansas; and
WHEREAS, the previous agreement for the water distribution
system is nearing its termination date; and it is therefore
desirable and necessary that the City of Johnson, Arkansas,
grant a new exclusive franchise to the City of Springdale, and
that said new franchise shall supersede any previous agreements
in conflict therewith; and
WHEREAS, under said franchise it is necessary and desirable
for the City of Johnson to grant to the City of Springdale, an
easement and right-of-way to lay, relay, install, maintain and
operate a water transmission line or lines over, under and
across,public streets, alleys and passage ways.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JOHNSON, ARKANSAS, AN'INCORPORATED TOWN, AS FOLLOWS:
SECTION I: The City of Johnson, Arkansas, an incorporated
town, hereby grants to the City of Springdale, acting through
its water commission,' an exclusive franchise, without charge or
franchise tax, to maintain and operate a public water distribution
system within that area of the City of Johnson, Arkansas,
lying north of Clear Creek, for a period of ten (10) years,
with the privilege of renewing such franchise for additional
periods of time.
SECTION II: The City of Johnson, Arkansas, an incorporated town,
further grants to the City of Springdale, acting through its
water commission, an easement and right-of-way to lay, relay,
install, maintain and operate a water transmission line or lines

over, under and across public streets, alleys and passage ways,
within that area of the City of Johnson, Arkansas, lying north
of Clear Creek.
SECTION III: All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby
repealed.
IT IS HEREBY DECLARED that an emergency exists and that
this ordinance be necessary for the preservation of the health,
safety and welfare of the citizens of the City of Johnson,
Arkansas, an incorporated town, shall become effective immediately
upon its passage and approval.
