AN ORDINANCE TO AMEND ORDINANCE NUMBER 57
THE SAME BEING AN ORDINANCE RELATIVE TO THE
OFFICE OF CITY ATTORNEY AND PROSECUTION OF
VIOLATIONS OF THE ARKANSAS HOT CHECK LAW.

WHEREAS, Ordinance No. 57, adopted January 6, 1981, directed'
the Johnson City Attorney and Office of the Marshall of Johnson,
Arkansas, to defer prosecution of violations of the Arkansas Hot
Check Law to the Prosecuting Attorney for the State of Arkansas,
4th Judicial District, wherein the amounts concerned are less
than twenty-five dollars ($25.00 ); and
WHEREAS, it is felt by the governing body of the Town of
Johnson, Arkansas, to be in the best interest of its citizens and
residents that said twenty-five dollar limit be reduced so as to
allow said citizens greater access to the judicial system in
regard to prosecution of violations of the Arkansas Hot Check
Law;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF JOHNSON, ARKANSAS:

Section 1: Ordinance 57 and any amendments thereto is hereby
amended so as to reduce the minimum amount for prosecution for
violations of the Arkansas Hot Check Law to ten dollars ($10.00)
and that the City Attorney and Marshall's Office of Johnson,
Arkansas be directed to defer prosecution of such violations to
the State Prosecuting Attorney wherein the amounts involved are
less than ten dollars ($10.00) per check.
Section 2: It is hereby declared that an emergency exists
and this ordinance being necessary for the preservation of the
health, safety and welfare of the citizens of Johnson, Arkansas,
shall become effective immediately upon its passage and approval.
