AN ORDINANCE TO AMEND THE ZONING DISTRICT
CLASSIFICATION AND BOUNDARIES REGARDING
PROPERTY IDENTIFIED IN ZONING PETITION

NO. 86-1

WHEREAS, the Johnson Planning Commission of the City of
Johnson, Washington County, Arkansas, has given the notice
required by law, and set the hearing date on July 7, 1986,
as the date for hearing the matter of rezoning the
hereinafter described tract of land from agricultural to
commercial; and

WHEREAS, it being the feeling of the City Council of
the City of Johnson, Arkansas, that the purpose of the City
Zoning Ordinance would be more properly carried out by such
rezoning, and that unless granted, the citizens of Johnson
will suffer irreparable harm and damage, and the owner of
said lands will be substantially deprived of the use of his
property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JOHNSON, ARKANSAS:
Section No. JL: That the zone classification of the
following described real property is hereby changed from
agricultural to commercial classification:

The Southwest quarter (SWl/4) of the Southwest
quarter (SWl/4) of Section Fifteen (15), except
the following described tract, to-wit: Beginning
at the Southeast corner of said 40 acre tract;
thence North 140.5 feet; thence West 928 feet;
thence South 22 degrees 30' West to the South line
of said 40; thence East to the point of beginning.
Also all that part of the southeast quarter
(SE1/4) of the Southeast quarter (SE1/4) of
Section sixteen (16), lying South and East of the
Fish Hatchery Road. Also part of the Northeast
quarter (NE1/4) of Section Twenty-one (21)
described as follows, to-wit; Beginning at the
Northeast corner of said (NE1/4) thence South
17.50 chains to the North line of the
Johnson-Greathouse Springs Road; thence
Northwesterly with the road to the East line of
the Northwest quarter (NWl/4) of the Northeast
quarter (NE1/4) and the intersection of the Mill
Race, thence Southwesterly with the Mill Race 92

feet; thence North 257 feet to the South line of
the Samuel Cox property; thence Northeasterly with
the Samuel Cox property to the East line of the
NWl/4.^ of the NE1/4; thence North to the Northwest
corner of the Northeast quarter (NE1/4) of the
Northeast quarter (NE1/4) ; thence East to the
point of beginning. Also a roadway 20 feet in
width on the East side of the Mill Race running
from the intersection of the Mill Race and the
Johnson-Greathouse Springs Road to the North bank
of Clear Creek. Also a strip of land used as a
public road, described as beginning at a point 24
rods East of the Southwest corner of the Southwest
quarter (SW1/4) of the Northeast quarter (NE1/4)
of Section Twenty-one {21:J; thence North 60 rods;
thence North 79 1/4 degrees East 30 feet; thence
South to the South line of said SW1/4 of the
NE1/4; thence West to the point of beginning, all
in Township Seventeen (17) North, Range Thirty
(30) West of the 5th P.M.
Section No. 2: That the official zoning district map
of the City of Johnson, Arkansas, is hereby amended to
reflect the zoning change set out in Section No . 1 above .
Section No. 3: It is hereby declared that an emergency
exists and that this ordinance being necessary for the
preservation, health, safety and welfare of the citizens of
Johnson, Arkansas, shall become effective immediately upon
its passage and approval.
