AN ORDINANCE AMENDING THE ORDINANCE
ESTABLISHING REGULATIONS FOR THE SALE
AND SHOOTING OF FIREWORKS IN THE CITY
OF JOHNSON, ORDINANCE NO. 89, SECTION
1, THE ORDINANCES OF THE CITY OF
JOHNSON, ARKANSAS, BY ADDING A SECTION
PROHIBITING THE POSSESSION AND
DISCHARGING OF ALL FIREWORKS WITHIN
THE CITY LIMITS OF JOHNSON, ARKANSAS.
WHEREAS, it has been brought to the attention of the
City Council of the City of Johnson, that the widespread
and uncontrolled use of fireworks causes substantial
harms to person and property in the City of Johnson, and
WHEREAS, such harm poses a serious threat to the health,
safety and general welfare of the community, and
WHEREAS, it has been determined by the City Council
of the City of Johnson, that an amendment to its Ordinance
regulating the sale and shooting of fireworks of the City
of Johnson, Ordinance No. 89, Section 1, which currently
restricts the discharging of any firecrackers, roman candles,
or any other fireworks within the corporate limits of the
city, except during the hours from 6:00 a.m. to 12:00 p.m.
on the 3rd of July, and from 6:00 a.m. to 12:00 p.m. on
Independence Day, July 4th, should be amended to prevent
such harm, and
WHEREAS, such amendment has been determined necessary
specifically regarding the sale, use, or exploding of any
fireworks to prevent such continuing harm.
NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE CITY
COUNCIL OF JOHNSON, ARKANSAS, that the Ordinance regulating
the sale, use or exploding of fireworks in the City of
Johnson, Arkansas, Section 1, restricting the use of
fireworks is amended as follows:

Section 1
It shall be unlawful for any person to offer for sale,
expose for sale, sell at retail, or use, or explode any
fireworks.
(This section of 'Ordinance 89, Sections 2 and 3, remain
intact and not effected by this amendment.)
Section 2
It shall be-unlawful for any person to offer for sale,
expose for sale, or sell at retail any fireworks within
the corporate limits of the City of Johnson.
Section 3 ....
Any person violating any of the provisions of this
Ordinance shall upon conviction, be deemed guilty of a
misdemeanor and shall be fined in any sum not less than
five ($5.00) dollars nor more than one hundred ($100.00)
dollars.
