AN ORDINANCE ACCEPTING DEDICATION OF A
RIGHT-OF-WAY FOR STREET EASEMENT ON CARLEY ROAD
IN THE TOWN OF JOHNSON, ARKANSAS; TO DECLARE
AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, various record title owners of certain real
property as set out in this Ordinance within the Town of
Johnson, Washington County, Arkansas, have conveyed a right of-
way and easement for the purpose of constructing,
maintaining, repairing, and replacing a public street (CarlV
Road); and
WHEREAS, the easement to be dedicated to the Town
of Johnson and accepted -thereby and the owners of each
tract, are hereby described as follows, to-wit:
TRACT I
Record title holder: Kenneth Tillotson and Lorean Tillotson,
Husband and Wife. Easement conveyed to the Town of Johnson:
A public road easement 50 feet in width described as being
the west 25 feet from the centerline of Carley Road as
it exits at this time, of the following described tract
of property:
A part of the Northwest Quarter of the Southeast Quarter
of Section Fifteen (15), Township Seventeen (17) North
of Range Thirty (30) West, described as follows: Beginningat
the southwest corner of the said 40 acre tract for a
beginning corner to the lands hereby intended to be conveyed
and running thence North 856.84 feet; thence East 940.5
feet; thence South 856.84 feet; thence West 940.5 feet
to the beginning corner and containing 18% acres, more
or less.
TRACT II
Record title holder: Kenneth Tillotson and Lorean Tillotson,
Husband and Wife. Easement conveyed to the Town of Johnson:
A public road easement 50 feet in width described as being
the east 25 feet from the centerline of Carley Road as
it exits at this time, of the following described tract
of property:
The South-east Quarter (SE%)' of the South-west Quarter
(SW%) of Section Fifteen (15), in Township Seventeen (17)
North, of Range Thirty (30) West of the 5th, P.M., Containing
40 acres, more or less.
TRACT III
Record title holder: Kenneth Tillotson and Lorean Tillotson,
Husband and Wife. Easement conveyed to the Town of Johnson:
A public road easement 50 feet in width described as being
the east 25 feet from the centerline of Carley Road as
it exits at this time, of the following described tract
of property:
The northwest quarter of the northeast quarter of section
fifteen (15) in township seventeen (17) north of range
thirty (30) west, of the 5th P.M. containing 40 acres,
more or less,
TRACT IV
Record title holder: Harold K. Mayes and Deborah L. Mayes,
Husband and Wife. Easement conveyed to the Town of Johnson:
A public road easement 50 feet in width described as being
the east 25 feet from the centerline of Carley Road as
it exits at this time, of the following described tract
of property:
Part of the Northwest Quarter (NW1/4) of the Southeast Quarter
(SE1/4) of Section Fifteen (15), Township Seventeen (17)
North, Range Thirty (30) West, and being more particularly
described as follows, to-wit: From the Northeast Corner
of the Northeast Quarter of said Southeast Quarter of Section
Fifteen, run South 89 degrees 58 minutes 31 seconds West
2068.57 feet to the POINT OF BEGINNING; and running thence
Sou/th 89 degrees 58 minutes 31 seconds West 581.0 feet;
thence South 0 degrees 16 minutes 58 seconds East 150.0
f eet; thence North 89 degrees 58 minutes 05 seconds East
581.0 feet; thence North 0 degrees 16 minutes 58 seconds
West 150.0 feet the the POINT OF BEGINNING. Containing
2.0 acres, more or less.
TRACT V
Record title holder: Dorcas Diven Curtis. Easement conveyed
to the Town of Johnson:
A public road easement 50 feet in width described as being
the west 25 feet from the centerline of Carley Road as
it exits at this time, of the following described tract
of property:
The Northeast Quarter (NE%) of the Southwest Quarter (SW%)
of Section Fifteen (15) in Township Seventeen (17) North,
Range Thirty (30) West, and containing forty (40) acres,
more or less.
WHEREAS, THE TOWN OF JOHNSON, WASHINGTON COUNTY,
ARKANSAS, finds that it is in the public interest for the
Town of Johnson to own such right-of-way with the right
to construct, maintian, and repair the public street.
IT IS THEREFORE ORDAINED BY THE CITY COUNCIL FOR THE
TOWN OF JOHNSON, WASHINGTON COUNTY, ARKANSAS, that the
Town of Johnson, Washington County, Arkansas, hereby accepts
said conveyance and dedication of the above easements,
over and across said tracts of land and in consideration
thereof, agrees that it will maintain a good and sufficient
street over the entire property as herein described in
each tract.
EMERGENCY CLAUSE: It is hereby declared that this
Ordinance, being necessary for the preservation
of the health, safety, and welfare of the citizens of the
Town of Johnson, Arkansas, should become effective
immediately upon its passage, approval, and publication.
