RESOLUTION 2015-8

A RESOLUTION AGREEING TO THE CHANGE IN
ZONING FROM C-2 TO C-3 FOR PROPERTY LOCATED
IN FAYETTEVILLE
WHEREAS, A.C.A. §14-56-306(b) requires that when adjoining land within a boundary
area between two cities is sought to be rezoned, the City Council of the City in which the
adjoining property is located must agree to any such rezoning; and
WHEREAS, the agent for the developer has requested and the City Council has
determined that the rezoning of the property in Fayetteville from C-2 to C-3 is compatible with
the adjoining area within the City of Johnson and will not adversely affect that area of Johnson.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JOHNSON, ARKANSAS:
That the City Council determined that the rezoning requested by the applicant, Carrie
LaFay, to rezone from C-2 to C-3 two parcels of land in Fayetteville as described on Exhibit A
and as shown on the map attached as Exhibit B, is compatible with the adjoining area within the
City of Johnson, will not adversely affect the adjoining area in Johnson and further hereby agrees
to the proposed change in zoning of the applicants' lots.

 

Legal Description
Lots 8 and 14 of the CMN Business Park II, Phase I and Phase II, located In the City of Fayetteville,
Arkansas, as shown on the final plat on file in the Office of the Circuit Clerk and Ex Officio Recorder of
Washington County Arkansas.
Containing approximately 17.70 acres more or less.
