A RESOLUTION AGREEING TO THE CHANGE IN
ZONING FROM R-A (RESIDENTIAL AGRICULTURE)
TO C-2, THOROUGHFARE COMMERCIAL AND C-3,
CENTRAL COMMERCIAL FOR PROPERTY LOCATED
IN FAYETTEVILLE ADJACENT TO JOHNSON

 

WHEREAS, A.C.A. §14-56-306(b) requires that when adjoining land within a boundary area between two cities is sought to be rezoned, the City Council of the City adjacent to the City In which the property is located must agree to any such rezoning; and

WHEREAS, an agent for the owner/developer has requested and the City Council has determined that the rezoning of the property in Fayetteville from R-A (RESIDENTIAL AGRICULTURE) to C-2. Thoroughfare Commercial and C-3. Central Commercial is compatible with the adjoining area within the City of Johnson and will not adversely affect that area of Johnson.

WHEREAS, the legal descriptions/map attached to Resolution 2016-02 contained an error as to the description of the property located in Fayetteville within 1000 feet of the Johnson city limits.

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JOHNSON, ARKANSAS:

That the City Council has determined that the rezoning requested by the applicant, Tom Terminella, to rezone from R-A (Residential Agricultural) to C-2. Thoroughfare Commercial and C-3. Central Commercial two parcels of land in Fayetteville. Owned by WG Land Company, and one parcel of land in Fayetteville, owned by McClinton, all as described on Exhibit A and as shown on the map attached as Exhibit B, is compatible with the adjoining areas within the City of Johnson, such rezoning by the City of Fayetteville will not adversely affect the adjoining areas in Johnson: the City Council further hereby agrees to the proposed changes in zoning of the described property.
