RESOLUTION NO.2018-26

A RESOLUTION AUTHORIZING EXECUTION OF
AMENDMENT NO. 1 TO AGREEMENT WITH HAWKINS-
WEIR ENGINEERS, INC.

WHEREAS, the City Council adopted Resolution No. 2018-15 on September 11. 2018, to authorize execution of a Professional Services Agreement (hereinafter the Agreement) with Hawkins-Weir to provide specified engineering services in regard to Main Drive and Wilkerson Road;

WHEREAS, the original Agreement approved by Resolution No. 2018-15 included services by Hawkins-Weir on a portion of Main Drive within the City of Springdale for which Springdale anticipated reimbursing the City for the value of such services:

WHEREAS, Springdale has not yet fully committed funds to reimburse the City and execution of that portion of the services is drawing near. an amendment to said Agreement to delete certain services by Hawkins-Weir 'from the Scope of Services is necessary; and.

WHEREAS, the City Council desires to move forward with Amendment No. 1 to the Agreement with Hawkins-Weir Engineers, Inc.

BE IT THEREFORE RESOLVED BY THE CITY COUNCIL OF JOHNSON, ARKANSAS,

that after due deliberation and consideration the attached Amendment No. 1 to the Professional Services Agreement with Hawkins-Weir Engineers, Inc. amending the engineering services described in the original Agreement, is hereby approved; the Council has determined that the interest of the City. its residents and occupants will be best served by accepting and entering into said Amendment No. 1 with Hawkins-Weir Engineers, Inc.

The Mayor and Recorder-Treasurer should be and hereby are authorized to execute and deliver signed copies of the attached Amendment No. 1 to Hawkins-Weir Engineers, Inc., and to take all steps necessary to secure the amended services and make payment for those services as invoiced per the amended Agreement.
